Terms of service

These terms are the agreement between you and Agency (“we” or “us”) when you use the Agency notes app at agencynotes.app. By creating an account or using Agency, you agree to them. If you do not agree, do not use Agency.

The privacy policy explains how we handle your data, and is part of these terms.

Who can use Agency

You must be at least 18 to use Agency. You are responsible for your account: keep your password to yourself, and tell us right away if you think someone else has used it. One person per account.

Your notes

You own what you write in Agency. You give us permission to store it, copy it, and send it to the services listed in the privacy policy, only as far as needed to run Agency for you. That permission ends when you delete the content or your account, except for copies in backups that are removed on their normal schedule.

You are responsible for what you put in Agency, and for having the right to put it there. Keep your own copy of anything you cannot afford to lose.

The AI features

Agency’s AI reads your notes, answers questions, and proposes changes. It can be wrong. It can misunderstand what you said, mishear a recording, or suggest something that does not fit you. Changes to your notes are shown to you to approve or edit first, and you decide what to keep.

Agency is a tool for reflection and organizing what you know. It is not medical, mental health, legal, or financial advice, and it is not a substitute for a professional. If you are in crisis, contact local emergency services or a crisis line.

Connected apps and agents

You can let other apps and AI agents use your Agency account, by signing them in or by giving them an access token. They can then read and write what you allow. You are responsible for what they do with that access, and you can revoke it at any time in Settings under Agent access.

Acceptable use

Do not:

• Break the law with Agency, or use it to harm, harass, or deceive anyone.
• Try to get into another person’s account or data, or into parts of Agency you are not given.
• Interfere with Agency, overload it, or probe it for weaknesses without our written permission.
• Use automated means to get around the free trial limit, such as making several accounts.
• Resell Agency or its AI features.
• Use the AI features to make content that the AI providers’ usage policies forbid.

Price, trial, and payment

Writing and reading notes is free. The AI features cost $10 a month, after a free trial of $5 of AI use. The subscription renews each month and is charged to your card through Stripe until you cancel. The pricing page states the full terms of the trial, cancellation, and refunds, and they are part of these terms.

If we change the price, we will tell you at least 30 days before it applies to you, and you can cancel before then. Prices do not include any taxes that apply where you live.

The subscription is priced for ordinary personal use. If the AI you use in a month costs Agency more than $8, measured by what the AI providers charge for your requests, we may slow or limit your AI features for the rest of that month. Your notes stay available either way.

Changes to Agency

Agency is being built and will change. We may add, change, or remove features. If we remove a paid feature in a way that makes Agency substantially less useful to you, you can cancel and ask us for a refund of the unused part of that month.

If we ever shut Agency down, we will give you at least 30 days’ notice and a way to download your notes.

Ending your account

You can stop using Agency and ask us to delete your account at any time by emailing agencynotesapp@gmail.com. We may suspend or close an account that breaks these terms. Unless the breach is serious or the law prevents it, we will tell you first and give you a chance to fix it and to download your notes.

Disclaimers

Agency is provided “as is” and “as available.” As far as the law allows, we make no promises beyond those in these terms, including that Agency will always be available, free of errors, or right about anything its AI says.

Limit of liability

As far as the law allows, we are not liable for indirect, incidental, special, or consequential losses, or for lost data, profits, or goodwill. Our total liability for any claim about Agency is limited to the greater of what you paid us in the 12 months before the claim and $50. Some places do not allow these limits, and where they do not, they apply only as far as the law allows. Nothing in these terms limits rights you have as a consumer that cannot be waived.

Disputes

If you have a problem with Agency, email us first. Most problems can be fixed that way. For a billing problem, the pricing page explains what to do before disputing a charge with your bank.

These terms are governed by the laws of the State of California. This does not take away protections you have under the consumer laws of the place where you live.

Changes to these terms

We may update these terms. We will change the date below, and for a change that matters, we will tell you by email or in the app at least 14 days before it takes effect. If you keep using Agency after that, the new terms apply. If you do not agree, you can cancel and delete your account.
